What Do You Do If You Have Been Arrested?

You have been arrested. It’s the first time and you must be scared and confused. What is the right way to deal with the situation? Following are some tips on how persons under arrest should conduct themselves so that they don’t make the situation any worse than it is.

Keep Quiet and CalmAfter an arrest, you are only required to give your identity to the arresting officer. Don’t say anything more that could be used against you. You also have the right to ask for a lawyer before you answer any questions or give any statement.It may not be easy but it is important to remain calm while in custody. Your behavior is under observation and may be given some unfavorable meaning that could be used against you in court.

After the Bail is SetIf you were arrested for a bailable offense and you have no lawyer yet, wait for the bail to be set. Ask to make a phone call to a family member or a friend but preferably to an attorney. During the call, continue to be calm and always remember that police officers are listening. Just say that you need bail but don’t discuss why you were arrested.

After your ReleaseAfter you are released from police custody, don’t discuss your case with anyone except your lawyer. However, take the time to recall everything that led to your arrest. You may write them down but be sure it does not go to the wrong hands.
