Motorcycle riders in Fort Worth know the feeling: open road, wind, and freedom. They also know the risk. When a crash happens, a rider has almost none of the protection a car occupant takes for granted. No steel cage. No airbags. No crumple zone. The body absorbs what the pavement and the other vehicle deliver.
Texas consistently leads the nation in motorcycle fatalities, and Tarrant County sees its share of serious injury cases every year. If you or someone you love was hurt in a motorcycle crash, you may be entitled to far more compensation than an insurance adjuster will offer in the first phone call.
The physics are unforgiving. A motorcycle weighs a fraction of what a sedan or pickup does, and a rider is exposed on all sides. That combination produces injuries that are often catastrophic rather than minor.
Common injuries after a Fort Worth motorcycle crash include:
Many of these injuries require multiple surgeries, months of rehabilitation, and a lifetime of accommodations. The costs do not end when the hospital bill arrives.
Texas personal injury law allows an injured rider to recover several distinct types of damages. Understanding them is the first step toward knowing whether an offer is fair.
Medical expenses. This covers emergency transport, hospital care, surgery, physician visits, prescriptions, physical therapy, assistive devices, and future medical care reasonably certain to be needed. Future medical costs are frequently the largest single component of a serious motorcycle claim, and they are the piece insurers most often try to ignore.
Lost income and earning capacity. If you missed work while recovering, those wages are recoverable. If your injuries prevent you from returning to your former job or reduce what you can earn long term, Texas law allows recovery for diminished earning capacity as well. For self-employed riders and contractors, this requires careful documentation.
Pain and suffering. This compensates for the physical pain, mental anguish, emotional distress, and loss of enjoyment of life caused by the crash. It is not a line item on a receipt, which is exactly why insurers fight it and why experienced representation matters.
Disability and disfigurement. Permanent limitations, scarring, and visible changes to appearance are compensable in their own right.
Property damage. Your motorcycle, helmet, riding gear, and any other damaged property are part of the claim. Helmets and protective clothing are expensive and often overlooked.
Loss of consortium. A spouse may have a separate claim for loss of companionship, society, and intimate relations.
Wrongful death damages. When a crash is fatal, surviving family members may recover funeral and burial expenses, loss of the deceased’s financial support, loss of inheritance, and mental anguish. Texas has specific rules about who may bring a wrongful death claim, so timing and eligibility need to be evaluated quickly.
Texas allows exemplary damages, sometimes called punitive damages, when a defendant’s conduct is proven grossly negligent or intentionally harmful. Drunk driving, extreme speeding, and hit and run conduct can support this. These damages are capped in most cases, but the caps are high and the threat of them changes how a case resolves.
If the at-fault driver’s insurance is insufficient, uninsured and underinsured motorist coverage on your own policy can step in. Many riders carry this coverage without realizing it. If a defective motorcycle part, tire, or helmet contributed to the crash, a product liability claim against a manufacturer may also exist.
Texas uses a modified comparative fault system. If a jury finds you partly responsible for the crash, your recovery is reduced by your percentage of fault. If you are found more than 50 percent responsible, you recover nothing.
This rule is why insurance adjusters work so hard to plant the idea that the rider was speeding, lane splitting, or not wearing a helmet. Helmet use in particular is a favorite tactic, even though Texas law only requires helmets for riders under 21 or without the appropriate training and insurance. A skilled attorney anticipates these arguments and builds the evidentiary record to defeat them.
Texas generally gives injured parties two years from the date of the crash to file a lawsuit. That sounds generous until you consider what has to happen first: evidence preservation, witness identification, expert retention, medical records collection, and negotiation. Waiting can destroy a strong case, and if a government entity is involved, the notice period can be measured in months, not years.
Motorcycle cases are not treated like ordinary car accident claims. Jurors sometimes carry assumptions about riders. Adjusters arrive with scripts designed to minimize payout. Defendants deny fault.
Paul Previte has spent 32 years in personal injury law in Fort Worth, first as a prosecutor and then as a judge before returning to advocate for injured people. That background means he has evaluated these cases from both sides of the bench and knows how insurance companies and defense attorneys build their positions. Previte Law Firm handles motorcycle accident cases on a contingency basis, meaning you pay nothing unless there is a recovery.
Preserve your helmet and gear. Photograph everything. Write down what you remember while it is fresh. Do not give a recorded statement to the other driver’s insurer, and do not accept an early settlement before you know the full extent of your injuries. Some of the most serious conditions, including traumatic brain injuries and spinal damage, are not fully understood for weeks or months.
