Slip and Fall Accidents: Who Is Responsible?

A slip and fall can happen in seconds, but the consequences often last for months or years. A wet floor at a grocery store, a broken step outside an apartment building, or an icy sidewalk in front of a Fort Worth business can lead to broken bones, head injuries, or damage to your back and spine. When this happens to you, one of the first questions you’ll ask is simple: who pays for this?

The answer depends on proving that someone else’s negligence caused your fall. Texas law does not automatically make a property owner responsible just because an accident happened on their property. You have to show they failed to act reasonably, and that failure is what hurt you.

The Legal Standard: Premises Liability

Slip and fall cases fall under a category of law called premises liability. Property owners, tenants, and business operators all have a duty to keep their premises reasonably safe for people who are lawfully on the property. This duty changes slightly depending on your legal status as a visitor:

  • Invitees are people invited onto the property for business purposes, like customers in a store. Property owners owe invitees the highest duty of care, including a responsibility to inspect for hazards and fix or warn about them.
  • Licensees are social guests or people on the property for their own purposes with the owner’s permission. Owners must warn licensees of known dangers, though the duty to inspect is lower.
  • Trespassers are owed the least protection, though owners still cannot intentionally cause harm.

Most slip and fall claims involve invitees, since they typically occur at stores, restaurants, office buildings, and apartment complexes.

Proving Negligence

Simply falling on someone else’s property is not enough to win a claim. You need to establish several elements to hold a property owner responsible:

The hazard existed. There was a genuinely dangerous condition, such as a spill, uneven flooring, poor lighting, a loose handrail, or a cracked parking lot surface.

The owner knew or should have known. This is often the most contested part of a slip and fall case. You must show the property owner had actual knowledge of the hazard, or that the hazard existed long enough that a reasonable inspection would have caught it. Surveillance footage, maintenance logs, and employee testimony often become critical evidence here.

The owner failed to fix or warn of the hazard within a reasonable time. A grocery store that leaves a spill unattended for twenty minutes during business hours behaves very differently than one that cleans it up within a minute of it happening. Timing matters enormously in these cases.

The hazard caused your injury. Medical records, incident reports, and witness statements help connect the fall directly to the injuries you are now dealing with.

Common Places Slip and Fall Accidents Happen

In Fort Worth and across North Texas, slip and fall accidents frequently occur in:

  • Grocery stores and retail shops, often due to spills or debris in aisles
  • Restaurants, where wet floors near kitchens or entrances go unmarked
  • Apartment complexes, where broken stairs, poor lighting, or icy walkways are neglected
  • Parking lots and garages, with potholes, cracked pavement, or oil spills
  • Office buildings and retail centers, where flooring transitions or loose mats create tripping hazards

Each of these locations carries a different owner, manager, or maintenance company, and figuring out exactly who is legally responsible often takes investigation.

Why Multiple Parties Can Share the Blame

Slip and fall cases are rarely as simple as “the store owner is at fault.” Responsibility can extend to several parties at once:

A property owner may lease space to a business, meaning both the landlord and the tenant business could bear some responsibility depending on who controlled maintenance. A management company hired to handle repairs and upkeep can also be named in a claim if they failed to address a known hazard. Contractors who recently performed work, such as flooring installation or landscaping, may be liable if their work created the dangerous condition. In some cases, manufacturers of flooring materials, mats, or equipment could share responsibility if a product defect contributed to the fall.

Sorting out these overlapping responsibilities is exactly the kind of work that requires legal experience, not guesswork.

Texas’s Comparative Fault Rule

Texas follows a modified comparative fault system. This means that if you are found partially responsible for your own fall, perhaps because you were looking at your phone or ignored a visible warning sign, your compensation can be reduced by your percentage of fault. If you are found more than 50 percent responsible, you may be barred from recovering anything at all.

This is precisely why property owners and their insurance companies work so hard to shift blame onto the injured person. Insurance adjusters are trained to ask questions designed to make the fall sound like it was your fault rather than a result of their negligence.

Why Experience Matters in These Cases

Slip and fall claims often come down to a battle of evidence and credibility. Insurance companies have teams of adjusters and lawyers working to minimize payouts, and they move quickly to gather statements and evidence that favor their position.

I spent years as a prosecutor and later as a judge before dedicating my career to representing injured people. That background gives me a clear understanding of how evidence needs to be gathered, how opposing counsel builds their arguments, and how a case looks from every side of the courtroom. Over 32 years handling personal injury cases in Fort Worth, I have seen how quickly property owners and their insurers try to close the door on legitimate claims.

If you or someone you love has been hurt in a slip and fall accident, do not assume you have no case just because the property owner denies fault. Get the facts investigated by someone who knows what questions to ask and what evidence matters.
