Truck Accident Claims in Texas: Why Are They Different?
A crash involving an 18-wheeler is not simply a car wreck with a bigger vehicle. The law, the evidence, and the parties involved all change. In Texas, truck accident claims follow a different set of rules than ordinary auto claims, and understanding those differences is often the difference between a fair recovery and an offer that leaves an injured family shortchanged.
There Is Usually More Than One Defendant
In a typical car crash, you sue the driver. In a truck crash, several parties may share responsibility:
Texas law allows a plaintiff to pursue multiple responsible parties, and each may carry its own insurance policy. Those policies often stack, which matters because damage caps and coverage limits differ dramatically between personal vehicles and commercial trucks.
The Insurance Numbers Are Not Close
Texas requires most private drivers to carry minimum liability coverage of 30/60/25. Commercial trucks operate under far higher financial responsibility requirements, and interstate carriers must meet federal thresholds. Because the available coverage is much larger, the defense side has far more at stake and far more resources to spend fighting your claim. Insurers for trucking companies routinely hire accident reconstructionists, biomechanical engineers, and medical experts before you have even left the hospital. The claim is not treated as routine from day one.
Federal Regulations Create the Rules of Proof
This is the heart of what makes truck cases different. Commercial trucking is governed by federal regulations that do not apply to ordinary drivers:
When a carrier violates these rules, that violation can become powerful evidence of negligence. A fatigued driver who pushed past the legal limit is not merely careless. The carrier may be directly liable for allowing it.
Evidence Disappears Fast
Trucking companies know how these cases work, and their legal teams move quickly. Federal regulations allow carriers to purge certain electronic logging device data and supporting documents after six months. Onboard electronic control module data in the truck itself may be overwritten in a much shorter window if the truck keeps operating.
That means the critical evidence in your case may be destroyed while you are still recovering from surgery. A prompt investigation and, in many cases, a spoliation letter demanding preservation of the data, can be the single most important step in the case. Waiting even a few weeks can permanently weaken a strong claim.
Fault Rules in Texas Work Against Careless Early Statements
Texas follows a modified comparative fault system. If you are found 51 percent or more responsible for the crash, you recover nothing. If you are 50 percent or less at fault, your recovery is reduced by your percentage of responsibility.
Trucking defense teams build fault narratives early. They look at your driving history, your statements at the scene, social media posts, and even the timing of your medical treatment. An offhand apology at the roadside or a delayed doctor visit can be used to shift blame. This is why what you say and post after a crash matters far more than most people realize.
The Damages and Deadlines Are Serious
Truck crashes tend to produce catastrophic injuries: traumatic brain injuries, spinal cord damage, amputations, burns, and wrongful death. Those cases involve large economic damages for lifetime medical care and lost earning capacity, along with non economic damages for pain, suffering, and loss of enjoyment of life.
Texas law sets a two-year statute of limitations for personal injury claims, running from the date of the crash. For a wrongful death claim, the two-year period runs from the date of death, which can be later than the crash itself. A claim against a government entity, such as a city or county vehicle or a road design defect case, carries a much shorter notice deadline. Missing these dates generally ends the claim entirely, no matter how strong the evidence might be.
Why Experience With These Cases Matters
Truck litigation rewards preparation and punishes delay. Retaining an attorney early, before evidence is lost and before the carrier finishes building its version of events, is often decisive. An attorney who has handled these claims knows which records to demand, how to read a driver log, how to work up a lifetime care plan, and how to stand up to a corporate defense team that has done this many times.
Paul Previte of Previte Law Firm brings a perspective most personal injury attorneys cannot offer. He is a former prosecutor and judge with 32 years of experience in personal injury law in Fort Worth, Texas. That background on both sides of the bench informs how he evaluates cases, anticipates defense strategy, and presents a claim built to survive scrutiny.
If you or a loved one was hurt in a crash with a commercial truck, the time to protect your rights is now.
